The criteria below are mentioned as per the Notification issued by the Ministry of Commerce Industry (Department for Promotion of Industry and Internal Trade - DPIIT) dated 4th February 2026: G.S.R. 108 (E)
The start-up should be incorporated as:
- Private Limited Company (as defined in the Companies Act, 2013) or
- Registered Partnership Firm (Regd. under section 59 of the Partnership Act, 1932) or
- Limited Liability Partnership (under the Liability Partnership Act 2008)
- The date of registration/incorporation should not be beyond 10 years.
- The startup should have an annual turnover not exceeding 200 Crores in any financial year since incorporation/registration.
- In case of an entity recognized as a 'Deep Tech Startup', the date of registration/incorporation should not exceed 20 years.
- In case of an entity recognized as a 'Deep Tech Startup', the annual turnover should not exceed 300 Crores in any financial year since incorporation/registration.
Original Entity
Entity should not have been formed by splitting up or reconstructing an already existing business.
Innovative Scalable
An entity should be working towards innovation, development, or improvement of products, processes, or services, or should have a scalable business model with high potential for employment generation or wealth creation.
